STONED FACE GENTLEMAN IN WAUSAU, OR MERRILL, WISCONSIN

This cabinet card portrait features a well dressed older man with a well groomed beard. Although his beard is full; it is not attached to sideburns. The gentleman appears tired and he exhibits no hint of a smile. The photographer of this photograph is Edgar G. Fleming. At the time that this photo was taken, Fleming had studios in both Wausau and Merrill, Wisconsin. According to a couple of Badger state directories, he was active in Wausau between 1884 and 1886 and active in Merrill between 1891 and 1895. These dates are not completely accurate because they do not show any overlap in years which would allow him to operate the two studios at the same time. Fleming also had a studio in Columbus, Wisconsin (1895-1896).   SOLD

FIVE WELL DRESSED HIKERS: CARRYING WALKING STICKS AND BINOCULARS

This vintage real  photo postcard features five men in their hiking attire. They certainly don’t seem to be wearing very comfortable clothing for a hike. I hope there was no scrambling or navigating slippery portions of the trail required. If so, their suit pants won’t have a long life span. Other than wearing clothing that may hamper their efforts, the men are well equipped with binoculars and walking sticks. The men have cases for the binoculars and the gentleman all the way on the left has a larger bag slung over his shoulder. The men are also well supplied with smoking materials. Two of the men have cigarettes/cigars and two others are holding a pipe. Interestingly, mustaches must have been in vogue considering that each of the men are wearing one. Hats must have been equally popular.  It would be fascinating to know the story of this gathering of outdoorsmen. The former owner of this image believes that the men are tourists, but he offers no supporting evidence. This vintage photo postcard is in very good condition (see scans).

A VERY FASHIONABLE GENTLEMAN IN BUFFALO, NEW YORK (PROMENADE CARD)

promenade

promenade 1The gentleman in this vintage photograph looks like he just walked off the page of an issue of Gentleman’s Quarterly. His jacket is buttoned with only the top button and he is wearing a wide tie and pocket handkerchief. Note the watch chain under his jacket as well as the boater hat and cane that he is holding. The photographer of this image is Andrew Simson (1837-1922). He emigrated to Buffalo at the age of 11 from Germany. At the beginning of his career he had a partner and the name of their firm was Upton & Simson. Simson had a number of  “claims to fame”. In 1901 he was an accredited photographer at the Pan American Exposition in Buffalo. He also is known for training Howard D. Beach (1867-1954). Beach was a great talent who worked in several disciplines. He was a portrait photographer, inventor, scientist, poet, lecturer and photo/art critic. He partnered with with Beach in 1896 (Simson & Beach) and in 1900 purchased Beach’s interest in the studio. Research revealed that Beach was considered the major photographer in Buffalo in regard to serving the “most cultured” citizens of the city. This photograph is not the same size as a cabinet card. It measures about 4 x 7 1/4 and is known as a “Promenade Card”.  The printed word “Promenade” can be seen in the center of the bottom border of this image. This beautiful vintage photograph is in excellent condition (see scans).

DISTINGUISHED GENTLEMAN IN PROVIDENCE, RHODE ISLAND

providence

providence 1

The photographic studio of  Heald and Giles produced this portrait of a distinguished older gentleman. The man is wearing a nicely groomed graying beard and mustache. He is displaying a serious expression on his face. Research reveals that Mr. Heald had a number of partners during his photography career. Among the names he operated his business under was Wright and Heald, and Heald and Erickson. The law journal, “Open Jurist” and several other turn of the century law journals, cite Mr. Heald in an important legal case. The case was “Corlis et. al. versus E. W. Walker Company et. al. (1894). Emily Corlis sued the Walker Company for inserting a portrait (photographed by Heald) of George H. Corlis in a biographical sketch about to be published. A photograph of the late Mr. Corlis had been submitted to the company by Emily Corlis but she had withdrawn her permission for them to use it after they had not complied with some of her demands. The Walker Company returned the photograph to her but then turned to Mr. Heald and purchased a copy of an original photograph Heald had taken of George Corlis. Emily Corlis was outraged and took Walker to court. The general policy of the courts, based on precedence. was that negatives of photographs belonged to photographers but the right to print negatives belonged to the customer (subject of the photograph).   The court in this case, however, ruled that this case was an exception to precedence because the rule applies only to “private persons”, and not “public characters”. The court stated that Mr. Corlis was a “public character” because of his status as the inventor of the Corlis Engine. It seems that his portrait had already appeared in a number of magazines and other publications. Stated simply, pubic characters had no right to privacy. In addition, the court stated that Walker could not be sued because  he was not the photographer. Only the photographer had a contractual obligation not to publish the subjects photograph without consent from the subject. To view the work of another photographer involved in an interesting court case  related to the business of photography, and to learn about that case, click on the category “Photographer: Rugg”. This cabinet card photograph is in very good condition (see scans).
